Hi,
My I-140/I-485 are pending. I had also applied for my EAD card which I received promptly. The EAD card will expire in October, 2008. You know, at least until the I-140 gets approved, I don't need the EAD card. Can I just let it expire and renew it when I need it? Or will it be a separate application when I try to renew an expired EAD.

Can people convert LC pending in BEC to PERM? If So, how safe it is and how much time it takes totally.
evaluate your pros and cons based on your own unique situations.
the BEC uses old generous rules to process applications. thus chances of success are better
perm is faster and thus you can get 140 done sooner to get 3 year extension instead of 1 year.
you can transfer priority date via perm. however if your case in perm is denied, you get into problem. you cannot then go back to BEC application.
bec should process cases by mid next year. there is lot of pressure on them. till now their performance has not been all that good and they are getting lot of flak for it.
in the current retrogression scenario, even if you get perm and 140 approved, you will still be in the back of the line at 485.
thus priority dates are more important. make sure any decision you take maintains your old date.

My corporate attorney told me that one is okay as long as one doesn't sya beyond 180 days from expiry without applying for a renewal, so you have 6 months to apply.
Better check with an attorney, but I am sure you are just fine.
Also, we had a 'nunc-pro-tunk' situation, but that kicks in only after 180 days , so I told.

I have Master's degree from US and have been with the company for 6yrs. This is the response from my Attorney on porting to EB2 category. My I485 was filed during July 2007. What can i do to be able to file a new PERM LC for porting to EB2 category without affecting my I485 application? Please advise.

since you are going to be an entrepreneur on EAD, your circumstances are kind of special (i.e. a GC or citizen entrepreneur doesn't have the extra baggage we carry). so u can join your state chapter in addition to the SBA.

I trust IV core members 99% for their efforts. But the remaining 1% does not come from the fear that IV is corrupt financially. It comes from the lack of information. If IV does not let the members know about their plans, how many members do the core expect to trust them and make an almost blind contribution? 1. pick up your phone and get ready to contribute.
2. call IV and during the call, contribute.
3. verify with IV that you are not a spy by giving your detailed information.
4. IV email you or mail you the ongoing plan.

Here is my situation:

Employer says he can file only 485 and no EAD for me. But he can file EAD/AP for my wife.
Can I file EAD/AP for me separately on my own? What are the consequences from my employer if I quit after six months of applying 485 (by that time I would've got my EAD/AP)? Can he reject my 140 and/or 485?
You can apply for EAD at anytime. All you will need is a copy of your I-485 AOS receipt (which I think USCIS will send to you, but I am not sure).

I am working on H1B. Recently what has happened that my family lives in state A, and I am working in state B. My family could not move to state B because my sone is going to school. I have to pay alot of expenses to go back and fort from state B to A, like air ticket and cab ect. I talking to my compnay regarding this and they said that whatever are my expenses submit to every month end and he will send a check for those expenses which will be pre taxed amount. i.e. if my pre taxed salary is $ 5000 per-month , if I submit expense statemet for $500. Then my employer will send a check of 500 and paystub i.e. direct deposit after applying tax on $4500.
I am not sure whatever he is suggesting is good tyhing to do and it will not have any problem for me.

I love no. 2, 3 and 4.
2 for the dynamic composition, 3 just cracked me up because the percussion instruments are so domineering and 4 seems pure concentration. 2 and 4 could maybe be cropped slightly, but that's very minor.

No more "status changes" e.g. f1->h1, L1->h1,even h4->h1 is allowed. Only Extensions are allowed in Mexico..
The USCIS site clearly states :

* Applicants seeking to renew their visa in any category except B1/2 (tourist/business), if the initial visa was issued in the applicant's home country.
Also Note(in blue font):
Notice: Certain visa applicants may be subject to additional administrative processing. This administrative processing may last weeks, thus delaying visa delivery and the applicant's return to the United States.
I'd rather prefer Canada for stamping(if these rules dont apply there) .

yes, now we should all start calling uscis - atleast 10 times a day, open SRs, take 4-5 infopass appointments and maybe consider going to NSC or TSC in person to see if we can talk to the IO (or have a cup of tea with the IO) to expedite our respective cases.
Who knows, if we do such things, we mite get our GCs faster than ppl already waiting ahead of us in the queue. :)
I wud also take this oppurtunity to invite more EB3 ppl to convert to EB2 now....this way, u cud get a EB-2 PD back in time, when u were not qualified for EB2. And with all desi body shops, getting this done is a piece of cake, i would assume.

I am thinking of starting my own company doing work similar to what I am employed for? Can I quit my job and start my own firm on EAD. I will be the sole proprietor and employee and the business would essentially operate as a startup for the foreseeable future. Will this be ok during I-485 adjudication? or do i need a regular job?

This is clearly a case of pharma companies wanting to make more money. My question is, why target only immigrants? There is something fishy here. I dont buy their argument. Fuck the green card. I'm not putting my wife through this shit. The sad part is that everything is commercialized in USA. Dont bring it upon your health. A slew of medicines have been pulled off the shelf and for heavens sake, this is a vaccine. I'm not scaring anybody.
